Abstract

Two court rulings, one in MAI Systems Corp., vs. Peak Computer Inc., and the other in National Car Rental System Inc. vs. Computer Associates International Inc., are discussed. In the MAI decision, the court rules that loading software into RAM creates an infringing copy of the software and is therefore copyright infringement. In the National Car Rental System case, the court rules that state law rather than federal copyright laws governs the extend to which a software licensee may use a licensed computer program
